Track Tennis Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access and use of the Track Tennis platform, including its cloud-based video streaming, recording, analytics, and related services (collectively, the "Service").

By using our Service, you agree to these Terms. If you do not agree, please discontinue using the Service.

2. Service Description

Track Tennis is a cloud-based video streaming and analytics platform designed for sports facilities, colleges, clubs, and organizations. Our features include:​
✔ Unlimited live streaming & recording of matches and training sessions​
✔ Automated match scheduling & score overlay​
✔ Video storage & analytics submission to third-party providers​
✔ Monetization tools (paywalls, sponsorship integrations, QR code check-ins)​
✔ White-label solutions for branding customization

3. Account Registration & Access

To access the Service, users must create an account by providing a valid email address. Users agree to:

• Provide accurate and up-to-date registration details
• Maintain the confidentiality of their login credentials
• Notify Track Tennis immediately if unauthorized access is suspected

Accounts may be suspended or terminated if there is misuse of the platform or violation of these Terms.

4. Content Ownership & Usage Rights

4.1 User-Generated Content

• Video recordings and livestreams generated on Track Tennis belong to the facility or user that owns the cameras.
• Users who purchase videos own their copy of the content for personal use.
• Track Tennis does not claim ownership over recorded matches or training sessions.

4.2 Responsibility for Content

• Track Tennis acts as a video infrastructure provider and is not responsible for
  user-generated content.
• Users are solely responsible for ensuring their content complies with applicable laws, including copyright and privacy laws.

4.3 Video Storage & Retention

• Users have control over recorded content and may delete or download videos at any time.
• Track Tennis does not guarantee indefinite storage of videos unless specified in a
  user’s subscription plan.

5. Payment & Subscription Terms

5.1 Fees & Billing

• Subscription fees vary depending on the number of courts and selected features.
• Payments are processed through third-party payment providers (e.g., Stripe).
• Users agree to provide accurate billing details and maintain valid payment methods.

5.2 Refund Policy

• Payments are non-refundable, except in cases where the Service fails due to a Track Tennis system error.
• Video purchases are non-refundable unless the content is undelivered or defective.

6. Platform Integrations & Third-Party Services

Track Tennis integrates with third-party services, including:

• Tournament & court management systems
• Analytics providers (e.g., Tennis Analytics, Tennis Comstat, Cizr Tennis, VS Pickleball, 7Shots)
• Payment processors (e.g., Stripe)

Track Tennis is not responsible for any failures or disputes arising from third-party services.

7. User Conduct & Prohibited Activities

By using Track Tennis, users agree NOT to:​
Upload, stream, or share illegal or copyrighted content without permission​
Use the Service for fraud, abuse, or unauthorized commercial purposes​
Distribute, resell, or modify the platform without prior approval​
Interfere with, hack, or disrupt Track Tennis infrastructure

Violating these Terms may result in account suspension or termination.

8. Data Privacy & Security

Track Tennis takes data security seriously. We:​
✔ Store all data on AWS cloud infrastructure with TLS encryption for data in transit and AWS KMS encryption for data at rest
✔ Follow strict authentication & access control policies​
✔ Do not sell or share personal data with third parties

9. Limitation of Liability

Track Tennis is not liable for:

• Loss of content due to user error, deletion, or storage limitations
• Internet or hardware failures affecting service performance
• Unauthorized access to user accounts due to weak passwords or security negligence
• Financial losses due to payment processing errors with third-party providers

Our liability is limited to the amount paid for the Service within the last 12 months.

10. Service Availability & Downtime

We strive for 99.9% uptime, but we do not guarantee uninterrupted service. Maintenance, updates, or external disruptions may cause temporary downtime.

Track Tennis is not responsible for any business losses due to service interruptions.

11. Termination & Account Suspension

We reserve the right to suspend or terminate accounts if users:

• Violate these Terms
• Fail to pay for the Service
• Engage in fraudulent or harmful activities

Users may cancel their subscription at any time by contacting info@track.tennis.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA.

• Disputes will be resolved through negotiation first.
• If unresolved, disputes will be handled by arbitration or legal proceedings in
  Delaware.

13. Changes to These Terms

Track Tennis reserves the right to update these Terms at any time.

• We will notify users of significant changes.
• Continued use of the Service after an update constitutes acceptance of new Terms.
